Legal notice
IMPORTANT NOTICE
Please read this Legal Notice carefully before purchasing, installing, operating, or using any hyperbaric chamber or associated equipment offered by Kaski (“Company,” “we,” “us,” or “our”).
Our products may include high-value hyperbaric oxygen therapy (“HBOT”) chambers, medical devices, pressurisation systems, oxygen delivery equipment, patient hoods, masks, replacement components, and associated accessories. Certain products may be regulated medical devices, including Class II medical devices in the United States.
These products may involve substantial financial commitments, specialised delivery requirements, medical supervision requirements, fire and oxygen hazards, and regulatory restrictions on sale or use.
By accessing this website, requesting a quotation, placing an order, or purchasing a product, you acknowledge that you have read this Notice. Contractual terms apply only to the extent they are properly incorporated into your agreement and permitted by applicable law.
This Notice supplements, and does not replace, our Terms and Conditions, Privacy Policy, Shipping and Delivery Policy, Returns and Refunds Policy, and any product-specific instructions, quotations, or signed purchase agreements.
1. COMPANY STATUS AND SCOPE OF NOTICE
Kaski operates as an e-commerce retailer, distributor, supplier, or authorised reseller of hyperbaric chambers and associated equipment, as applicable to each product.
Unless expressly stated in writing for a specific product, we do not represent ourselves as a hospital, medical clinic, physician, medical practitioner, diagnostic provider, or emergency treatment facility.
The regulatory status of each product depends on its manufacturer, intended purpose, model, technical configuration, jurisdiction, applicable authorisations, and accompanying labelling.
References to “medical device,” “Class II,” “FDA-cleared,” “CE-marked,” “UKCA-marked,” “prescription device,” or similar regulatory terms apply only where supported by the relevant product documentation and legal requirements.
No statement on this website should be interpreted as representing that every chamber we sell has the same regulatory classification, clearance, approval, or authorised indications for use.
2. FDA REGULATORY STATUS AND INDICATIONS FOR USE
2.1 Product-specific FDA clearance
In the United States, certain hyperbaric oxygen therapy devices are regulated as Class II medical devices and may be cleared through the FDA 510(k) premarket notification process.
FDA clearance is specific to the relevant device and its authorised intended use. It must not be interpreted as a blanket endorsement of every hyperbaric chamber, accessory, treatment protocol, or health claim associated with hyperbaric oxygen therapy.
Where applicable, the relevant product listing, clearance documentation, manufacturer labelling, and Instructions for Use (“IFU”) should be consulted before purchase or use.
FDA device information is available at: https://www.accessdata.fda.gov/scripts/cdrh/cfdocs/cfpmn/pmn.cfm
2.2 Indications for Use
The indications for use of any FDA-cleared device are limited to those specified in the applicable FDA clearance documentation and manufacturer-authorised labelling.
Depending on the particular cleared device, authorised indications for hyperbaric oxygen therapy may include one or more of the following:
-
Air or gas embolism.
-
Carbon monoxide poisoning, including specified cases involving cyanide poisoning.
-
Decompression sickness.
-
Clostridial myositis and myonecrosis.
-
Crush injuries, compartment syndrome, and other acute traumatic ischaemias.
-
Selected problem wounds for which enhanced healing is indicated.
-
Exceptional blood-loss anaemia.
-
Necrotising soft-tissue infections.
-
Refractory osteomyelitis.
-
Delayed radiation injury involving soft tissue or bone.
-
Compromised skin grafts and flaps.
-
Thermal burns.
-
Intracranial abscess.
The foregoing list is illustrative, not a universal statement of clearance for every product we sell. The applicable indications must be confirmed against the exact device's FDA clearance and current labelling before being attributed to that device.
For each product, customers should consult the manufacturer’s IFU and applicable regulatory documentation. Where the device is not FDA-cleared for a proposed indication, no representation to the contrary is made.
2.3 No implied FDA endorsement
The Company does not imply that the FDA has independently endorsed our website, commercial statements, testimonials, customer experiences, or general claims about hyperbaric oxygen therapy.
FDA clearance of a particular device does not establish that every advertised use is cleared, that a particular patient will benefit, or that the device is appropriate for every individual.
3. OFF-LABEL USE AND PROHIBITED MEDICAL CLAIMS
3.1 Off-label use disclaimer
Hyperbaric chambers may be used by some clinics, practitioners, researchers, or individuals for purposes beyond the indications specified in a particular device’s authorised labelling. Such purposes may include anti-ageing, sports recovery, neurological wellness, cognitive enhancement, general wellness, or other investigational applications.
The Company does not claim, represent, warrant, or guarantee that any chamber or associated product is safe, effective, FDA-cleared, FDA-approved, or otherwise authorised to treat, prevent, cure, or mitigate any condition for which that specific device lacks the necessary regulatory authorisation.
The fact that a third party offers, recommends, studies, or performs a particular application does not establish that the application is an authorised indication, that clinical efficacy has been established, or that the use is appropriate for a particular patient.
Customers must not infer product approval for an unlisted condition from general descriptions of hyperbaric oxygen therapy, third-party publications, testimonials, customer reviews, or references to scientific research.
3.2 No guarantee of therapeutic outcomes
The Company makes no guarantee of a particular medical, physiological, cosmetic, athletic, neurological, or wellness outcome.
Individual responses may vary. A purchase does not establish medical suitability, and the Company does not promise that use will produce any specific therapeutic result.
Nothing in this Notice is intended to exclude liability for a false or misleading representation where such exclusion would be unlawful.
3.3 Third-party claims and testimonials
Testimonials, reviews, case studies, practitioner statements, research summaries, and third-party marketing materials are not substitutes for regulatory authorisation or individual medical assessment.
Unless expressly identified and substantiated, third-party claims should not be treated as claims made or verified by the Company.
The Company does not adopt an otherwise unauthorised medical claim merely by referring to a third-party source. All Company-controlled product descriptions and advertising remain subject to applicable advertising, consumer-protection, and medical-device laws.
4. MEDICAL ADVICE, CONTRAINDICATIONS AND SAFE USE
4.1 No medical advice
Information provided through this website, email, telephone, quotation, or customer support is for product information and commercial purposes only. It is not a substitute for diagnosis, treatment, or advice from a qualified healthcare professional.
The Company does not determine whether hyperbaric oxygen therapy is clinically appropriate for a particular person.
4.2 Medical assessment and supervision
Customers must consult an appropriately qualified healthcare professional before commencing treatment, particularly where a medical condition, medication, implanted device, or other factor could affect suitability.
Hyperbaric treatment may present risks, including barotrauma, ear or sinus injury, oxygen toxicity, temporary visual changes, and fire-related hazards. Individual risks depend on the device, operating conditions, treatment protocol, and patient circumstances.
Customers must comply with all applicable medical supervision requirements, manufacturer instructions, safety warnings, maintenance schedules, and training requirements.
4.3 Fire, oxygen and electrical safety
Hyperbaric oxygen therapy involves elevated pressure and, depending on the system, oxygen-enriched environments. Oxygen materially increases fire risk.
Customers are responsible for ensuring that the chamber is installed, operated, inspected, maintained, and used in accordance with the manufacturer's instructions and all applicable safety requirements.
No unauthorised modifications, incompatible accessories, prohibited electrical or static-generating items, or unapproved operating procedures may be introduced into the system.
The Company does not authorise any customer to disregard manufacturer safety requirements or operate equipment outside its specified operating parameters.
FDA safety information is available at: https://www.fda.gov/medical-devices/letters-health-care-providers/follow-instructions-safe-use-hyperbaric-oxygen-therapy-devices-letter-health-care-providers
5. PRESCRIPTION-ONLY AND RESTRICTED-SALE POLICY
5.1 Federal law warning
For each device whose applicable United States labelling restricts sale to prescription use, the following warning applies:
“Caution: Federal law restricts this device to sale by or on the order of a physician.”
This warning applies where required by the relevant federal law and device labelling. It must not be interpreted as establishing prescription-only status for every product listed on our website or overriding a different applicable legal requirement.
5.2 Mandatory regulatory verification before dispatch
Where a product is subject to a prescription, professional-order, or other legal sale restriction, the order will be placed on REGULATORY HOLD pending verification of the documentation legally required for that transaction.
The affected order will not ship until the applicable documentation has been received, reviewed, and verified.
Depending on the product and jurisdiction, the required documentation may include:
-
A valid, signed prescription or written order from an appropriately authorised physician or other legally authorised prescriber; and/or
-
Evidence of the purchasing healthcare professional's current licence, registration, or other legally required professional authorisation; and/or
-
Additional purchaser, facility, intended-use, or regulatory documentation reasonably required to establish lawful sale and delivery.
A professional licence alone will not be treated as a substitute for a prescription or written order where the applicable law requires one.
Documentation must identify the relevant purchaser or authorised recipient and satisfy the applicable legal and product-specific requirements. We may request clarification, updated documents, or verification from the issuing authority where reasonably necessary.
5.3 Verification and order cancellation
We reserve the right to delay, decline, suspend, or cancel a transaction where required documentation is absent, invalid, expired, inconsistent, unverifiable, or insufficient to establish lawful sale.
Any cancellation and refund will be handled in accordance with the applicable purchase agreement and mandatory law.
We will not knowingly dispatch a restricted medical device in breach of an applicable prescription or professional-order requirement.
5.4 International customers
A prescription or professional licence issued in one country does not necessarily satisfy the requirements of another country.
Customers are responsible for providing information reasonably required to establish the lawfulness of the proposed transaction, while the Company remains responsible for complying with the legal obligations applicable to its own sales activities.
6. MEDICAL-DEVICE COMPLIANCE BY JURISDICTION
6.1 United States
For United States transactions, applicable requirements may include the Federal Food, Drug, and Cosmetic Act, FDA medical-device regulations, device-specific labelling, prescription-sale restrictions, advertising requirements, and other applicable federal and state laws.
The Company's representations concerning clearance, classification, and indications are limited to the relevant device documentation.
6.2 United Kingdom
For United Kingdom transactions, the relevant requirements may include the UK Medical Devices Regulations 2002, as amended, applicable MHRA requirements, product marking and conformity obligations, and other relevant product-safety and consumer-protection legislation.
The Company will supply products for the UK market only subject to the regulatory requirements applicable to the product, transaction, and supply chain.
A United States FDA clearance does not, by itself, establish compliance with UK medical-device requirements.
6.3 European Union and other territories
Customers purchasing from or arranging delivery to the European Union or another territory must comply with the applicable medical-device, importation, registration, conformity-assessment, customs, and local-use requirements.
The availability of a product for sale on this website does not guarantee that it can lawfully be imported, marketed, installed, or used in every jurisdiction.
Where the Company cannot lawfully fulfil an order for the proposed destination, it may decline or cancel the transaction and process any refund in accordance with applicable law.
7. HIGH-VALUE QUOTATIONS, ORDER ACCEPTANCE AND MANUFACTURER ALLOCATION
7.1 Formal quotation process
Hyperbaric chambers are high-value specialist products that may require manufacturer allocation, configuration, manufacturing capacity, specialised handling, freight arrangements, site assessments, and installation planning.
A quotation may specify:
-
Product model and configuration.
-
Included accessories and excluded items.
-
Currency, price, taxes, and duties.
-
Deposit and balance-payment schedule.
-
Estimated production and delivery dates.
-
Freight, unloading, and installation arrangements.
-
Site-readiness requirements.
-
Warranty and after-sales support.
-
Cancellation, return, and restocking terms.
The quotation and the applicable purchase agreement should be read together.
7.2 Manufacturer allocation and non-standard costs
Upon acceptance of a quotation, the Company may commit funds or incur non-recoverable costs associated with manufacturer allocation, custom configuration, production, transport, insurance, specialist freight, or other customer-specific arrangements.
Where such costs are expressly disclosed and lawfully recoverable under the applicable agreement, the customer may be responsible for them in the event of a cancellation or other contractual breach.
No provision in this section overrides a mandatory statutory cancellation right, refund entitlement, or other non-excludable legal protection.
7.3 Order confirmation
An order is subject to the acceptance procedure stated in the quotation and Terms and Conditions. Payment processing, receipt of an order enquiry, or an automated acknowledgement does not necessarily constitute final acceptance where the agreement expressly provides otherwise.
No order may be dispatched where doing so would breach an applicable regulatory restriction.
8. SITE READINESS, DELIVERY ACCESS AND INSTALLATION LIABILITY
8.1 Buyer responsibility for site readiness
The buyer is responsible for ensuring, before dispatch, that the delivery and installation site is suitable for the selected chamber and all associated equipment.
Depending on the model and configuration, a chamber may weigh approximately 1,200 lb (544 kg) or more. The actual weight, dimensions, handling requirements, and electrical specifications must be confirmed from the applicable manufacturer's documentation.
Before approving dispatch, the buyer must assess and, where appropriate, obtain qualified professional confirmation of:
-
Doorway, corridor, stairway, lift, and access-route dimensions.
-
Floor loading capacity and structural support.
-
Loading-bay, driveway, turning, and vehicle access.
-
Safe unloading, lifting, positioning, and movement arrangements.
-
Electrical supply, circuit capacity, grounding, and other specified utilities.
-
Ventilation, clearances, environmental conditions, and installation space.
-
Fire protection, oxygen safety, and other applicable site requirements.
-
Any permits, building approvals, or specialist installation arrangements.
The buyer should not assume that a standard delivery vehicle, pallet truck, tail lift, stairway, or residential entrance can accommodate the equipment.
8.2 Written site-clearance confirmation
Before dispatch, the Company may require a signed site-readiness declaration, access questionnaire, delivery clearance, or other written confirmation appropriate to the order.
The buyer must provide accurate information and disclose any known access, structural, electrical, or installation limitations.
A signed declaration is evidence of the information and confirmations supplied by the buyer; it does not waive any non-excludable rights or relieve the Company or its contractors of their own legal obligations.
8.3 Failed delivery due to site unpreparedness
If a carrier attends the agreed delivery location but cannot complete delivery because of an access restriction, inadequate site preparation, unavailable authorised personnel, or another circumstance within the buyer's reasonable control, the delivery may be rescheduled.
Where the failed delivery is attributable to the buyer's failure to satisfy the agreed site-readiness requirements, the buyer may be charged the reasonable, documented costs of the failed delivery, return freight, storage, redelivery, and any additional handling, to the extent permitted by the applicable contract and law.
Any applicable fees should be disclosed in the quotation or delivery terms before the customer commits to the purchase. We will not treat these charges as automatically payable where they are prohibited by law or where the failed delivery is attributable to the Company or its carrier.
8.4 Delivery estimates and carrier limitations
Delivery dates are estimates unless expressly guaranteed in writing.
Delivery may be affected by manufacturer production schedules, freight availability, customs clearance, weather, transport restrictions, site access, and other factors outside the Company's reasonable control.
We will communicate material changes and comply with applicable delivery obligations. Nothing in this section excludes remedies available for non-delivery, unreasonable delay, or breach of contract.
8.5 Installation and commissioning
Unless expressly included in the quotation, the purchase price does not include building works, electrical upgrades, structural modifications, specialist lifting, commissioning, clinical training, or other installation services.
Customers must not operate the chamber until all required installation, inspection, commissioning, and training steps have been completed in accordance with the manufacturer's instructions and applicable law.
9. RETURNS, CANCELLATIONS AND RESTOCKING FEES
9.1 Authorisation required
Because hyperbaric chambers are high-value specialist products, returns require prior written coordination with the Company.
Customers must contact kaski@gmail.com before arranging a return or dispatching any equipment.
Unauthorised returns may be refused where legally permissible. Returned equipment must be packaged, handled, and transported in accordance with the manufacturer's requirements and any applicable dangerous-goods, medical-device, and freight rules.
9.2 Product condition and hygiene requirements
Chambers, patient-contact components, oxygen hoods, masks, tubing, seals, and related accessories may be subject to hygiene, contamination-control, inspection, and manufacturer-reconditioning requirements.
Any inspection, decontamination, recertification, or refurbishment must be undertaken by an appropriately qualified party where required.
A product's status as a medical device does not automatically eliminate a customer's statutory cancellation or refund rights. Return restrictions must be assessed by product type, condition, applicable hygiene rules, and governing law.
9.3 Discretionary returns and restocking fees
For a return that is legally permissible but not required by law, the Company may impose a restocking fee of 15% to 30% of the applicable product price, where that fee has been clearly disclosed before purchase, incorporated into the applicable agreement, and is lawful and reasonable in the circumstances.
The precise fee, its calculation, and any additional transport, inspection, refurbishment, or handling charges must be identified in the quotation or applicable return terms.
A restocking fee will not be imposed to the extent it would unlawfully restrict statutory cancellation rights, penalise the exercise of a protected right, or operate as an unenforceable contractual penalty.
Custom-configured, specially manufactured, or manufacturer-allocated equipment may be subject to additional restrictions where permitted by law and expressly agreed before the order is placed.
9.4 Used oxygen hoods and masks
For hygiene and patient-safety reasons, oxygen hoods, masks, and other designated patient-contact accessories that have been used, opened, or contaminated may be ineligible for discretionary return or resale where this is supported by applicable hygiene requirements, product characteristics, and the disclosed contractual terms.
This restriction does not exclude a customer's mandatory rights where the item is faulty, misdescribed, unsafe, or otherwise subject to a statutory remedy.
Where a statutory exception to cancellation applies, we will identify the applicable basis and provide any required pre-contract information. We will not treat every opened medical accessory as automatically exempt from consumer cancellation rights.
9.5 Faulty, damaged or misdescribed goods
Nothing in this Notice limits a customer's statutory rights concerning defective, unsafe, damaged, or misdescribed products.
Customers should report visible transit damage promptly, retain relevant packaging and delivery records, and provide photographs where reasonably requested. Failure to report damage immediately will not, by itself, remove a mandatory legal remedy.
The Company will assess claims and provide any repair, replacement, refund, or other remedy required by the applicable contract and law.
9.6 Refund processing
Approved refunds will be processed within the period required by applicable law and the relevant payment provider's procedures.
Where a refund is legally due, the Company will not withhold it merely because a manufacturer, carrier, or third party has not reimbursed the Company.
10. PAYMENT DISPUTES, CHARGEBACKS AND DOCUMENTATION
10.1 Good-faith dispute resolution
Given the high purchase value and specialised fulfilment arrangements associated with these products, customers are encouraged to contact kaski@gmail.com promptly if they believe there has been an error, delivery problem, contractual breach, or other dispute.
Where appropriate, the parties should attempt to resolve the issue through documented written communication and good-faith mediation before escalating the dispute, provided this does not interfere with any mandatory legal right or applicable payment-provider deadline.
10.2 Manufacturer commitments and allocated costs
A quotation may trigger manufacturer allocation, bespoke configuration, production scheduling, freight reservations, insurance arrangements, or other commitments.
Where a customer raises a payment dispute or initiates a chargeback, the Company may submit relevant evidence to the payment processor, acquiring bank, card network, or other authorised dispute-resolution body.
Evidence may include:
-
The accepted quotation and purchase agreement.
-
Product specifications and disclosures.
-
Applicable prescription or regulatory-verification records.
-
Signed site-readiness and access-clearance documents.
-
Delivery instructions and customer correspondence.
-
Manufacturer allocation and production records.
-
Freight bookings, tracking information, and proof of delivery.
-
Inspection reports and records of agreed additional costs.
-
Refund offers, service records, and prior attempts at resolution.
Such evidence will be submitted where relevant and permitted by law, contractual requirements, and applicable data-protection rules.
10.3 Chargeback disputes
Where a chargeback is initiated in circumstances inconsistent with the accepted agreement or the available transaction evidence, the Company reserves the right to contest the chargeback using the relevant signed quotation, site-clearance documents, delivery records, manufacturer commitments, and other admissible evidence.
Where practicable, the Company requests that customers notify us in writing and allow a reasonable opportunity for resolution before escalating a dispute.
However, this provision does not prohibit a customer from exercising a lawful chargeback right, disputing an unauthorised transaction, reporting fraud, asserting a statutory remedy, or using a payment-provider dispute process. It does not make the customer automatically liable for every chargeback or associated fee.
10.4 No automatic waiver of consumer rights
Nothing in this Notice requires a customer to surrender mandatory legal protections or purports to prevent a payment processor, card issuer, court, regulator, or other competent body from considering a dispute under its applicable rules.
The Company's right to contest a chargeback is distinct from the question of whether the chargeback or underlying customer claim is ultimately valid.
11. PRODUCT WARRANTIES, LIMITATIONS AND LIABILITY
11.1 Manufacturer warranties
Products may be supplied with a manufacturer's warranty, subject to the applicable written warranty terms.
The Company will identify any separate retailer warranty or additional service commitment in the applicable quotation or sales documentation.
A manufacturer's warranty does not replace any statutory rights that cannot lawfully be excluded.
11.2 No unauthorised warranty extension
No sales representative, website statement, testimonial, or informal communication extends a manufacturer's warranty unless the extension is expressly confirmed in writing by an authorised representative of the party providing it.
11.3 Liability limitations
To the fullest extent permitted by applicable law, the Company is not responsible for losses arising solely from a customer's failure to follow the manufacturer's instructions, unauthorised modifications, improper installation by a third party, use outside the specified operating parameters, or failure to maintain the equipment as required.
This provision applies only to the extent that the relevant loss was caused by the identified conduct and the limitation is lawful in the circumstances.
Nothing in this Notice excludes or restricts liability that cannot legally be excluded or restricted, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other non-excludable liability under the applicable law.
11.4 No guarantee of uninterrupted operation
Unless expressly agreed in writing, the Company does not guarantee uninterrupted availability of manufacturer support, third-party services, consumables, replacement components, or future software and hardware updates.
Any specific service-level commitment must be documented in the applicable agreement.
12. DATA PROTECTION AND REGULATORY DOCUMENTATION
Prescription records, professional licences, purchaser identification, facility information, and other compliance documents will be requested only where reasonably necessary for order processing, verification, legal compliance, fraud prevention, or another lawful purpose.
Such information will be handled in accordance with the Company's Privacy Policy and applicable data-protection legislation.
Customers should submit sensitive documentation only through [Secure Upload URL or Approved Secure Submission Method]. Do not email unnecessary patient records or unrelated medical information.
The Company may retain relevant transaction and compliance records for the period required by law, applicable regulatory obligations, payment-provider requirements, and legitimate recordkeeping purposes.
13. GOVERNING LAW AND DISPUTE RESOLUTION
The governing law, competent courts, and any agreed dispute-resolution procedure are specified in the Company's Terms and Conditions and the applicable purchase agreement.
Mandatory consumer protections applicable to the customer or transaction remain unaffected.
Nothing in this Notice is intended to create a jurisdictional exclusion, mandatory arbitration obligation, waiver of statutory rights, or restriction on access to a competent regulator or court where such provision would be unlawful.
14. AMENDMENTS AND DOCUMENT PRIORITY
The Company may update this Notice to reflect changes in law, regulatory guidance, product availability, or business practices.
The version applicable to an individual transaction will be determined in accordance with the applicable agreement and law. A website update will not retrospectively remove an existing contractual right or impose a new material obligation on a customer without an appropriate legal basis.
If a provision of this Notice is held invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

FINAL NOTICE: Hyperbaric chambers are specialised products that may be subject to medical-device regulation and significant operational hazards. Customers must verify product-specific authorisations, obtain any legally required prescriptions or professional orders, ensure suitable site preparation, and follow the manufacturer's instructions before use.
